Negligent Operation of a Motor Vehicle

The Halifax Police Department sought to have Attorney Fogarty’s client charged with the crime of Negligent Operation of a Motor Vehicle in the Plymouth District Court. The matter was brought before a Clerk Magistrate for a hearing. Attorney Fogarty argued successfully that the application for criminal complaint lacked probable cause. The Clerk Magistrate agreed and did not issue the criminal complaint. As a result, Attorney Fogarty’s client did not have to face this criminal charge and the matter remained off of their driving record as well.
